Woman who sued doctor for allowing her to be born wins court case

This 20-year-old lady sued her
mother’s doctor for her childbirth,
won the case, and her lawyers say
there is still a large amount of
compensation to be calculated.

She accused the family doctor of not advising her mother by the time she became pregnant and
took the right action, inaction that resulted in her being born with spina bifida.

Evie Toombes, a jumper who lives with a spina bifida, presented the landmark case against Dr Philip
Mitchell, who led to the landmark
Judgment.

According to her, the negligence
of the doctor led to a “false
conception” that gave birth to her.

She argued that Dr Philip Mitchell did not advise her mother to take
folic acid supplements to avoid
having a baby with spina bifida.

Her mother told the court: “I was advised that if I had a good diet previously, I would not have to take folic acid.”

She said that due to her condition, she is sometimes connected to tubes for 24 hours.

Spina bifida is a neural tube defect (NTD) that affects the spine, making it impossible
for the spine, which protects the
spinal cord, to form and close.

This often leads to damage to the
spinal cord and nerves, which leads
to physical and mental
disabilities.

Interestingly, Judge Rosalind Coe QC agreed with Evie Toombes in London on Wednesday, December 1, saying she would have been born healthy if her mother had gotten the right advice from Dr Philip Mitchell.

“If Evie’s mother had been provided with the correct recommended advice, she would have delayed attempts to conceive,” Judge Rosalind Coe QC ruled.

Although no exact amount has been determined yet, Toombes’ compensation is expected to be huge because it must be sufficient to cover her healthcare for life.
